These Terms & Conditions govern access to and use of the Anantara Law website and the legal services we provide. Questions may be directed to [email protected].
1. Definitions
- "Anantara Law", "we", "us", "our" refers to the legal practice operating under that name from 78 Asok Montri Road, Khlong Toei, Bangkok 10110, Thailand.
- "Services" means the pension defense legal services we offer, as described on this website and in individual engagement letters.
- "User", "you", "your" means any person who accesses our website or contacts us in relation to our Services.
- "Engagement Letter" means the written document we provide setting out the scope, fees, and terms of a specific legal engagement.
- "Website" means the website operated at anantara.live.
2. Acceptance of Terms
By accessing our website or contacting us to enquire about our Services, you acknowledge that you have read and agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or engage our Services.
Our Services are available to individuals who are 18 years of age or older and who have the legal capacity to enter into a contract. By submitting an enquiry or engaging our Services, you confirm that you meet these requirements.
3. Service Description
Anantara Law provides legal services relating to pension and retirement entitlement matters in Thailand, including:
- Pension Records Reconciliation — review of contribution records across Thai and overseas institutions, delivered as a written summary.
- Pre-Hearing Strategy Engagement — structured preparation for administrative or tribunal hearings, including strategy review, document refinement, and witness preparation.
- Comprehensive Pension Defense — full-service legal representation from initial review through trial and appellate stages.
The specific scope of any Service is set out in the Engagement Letter agreed with each client before work commences. This website provides general information only and does not constitute legal advice.
Our Services are directed primarily at individuals with pension or retirement entitlement matters connected to Thailand. We cannot guarantee availability of Services in all circumstances, and we may decline to accept an engagement at our discretion.
4. User Responsibilities
When using our website and engaging our Services, you agree to:
- Provide accurate, complete, and up-to-date information when contacting us or in the course of an engagement.
- Not use the website for any unlawful purpose or in a way that infringes the rights of others.
- Not attempt to gain unauthorised access to any part of our systems or data.
- Not reproduce, distribute, or adapt any content from this website without our written consent.
- Notify us promptly if circumstances relevant to your matter change.
5. Intellectual Property
All content on this website — including text, structure, design, and visual elements — is owned by or licensed to Anantara Law. You may access and view this content for personal, non-commercial use only.
Documents and written advice produced by Anantara Law in the course of an engagement remain our intellectual property until the relevant fees are paid in full, at which point the right to use those documents for the purposes of your matter transfers to you.
6. Fees and Payment
All fees are stated in Thai Baht (฿) and are set out in the relevant Engagement Letter before any work begins. Our current service fees are:
- Pension Records Reconciliation: ฿2,400
- Pre-Hearing Strategy Engagement: ฿9,200
- Comprehensive Pension Defense: ฿10,500 (base engagement fee)
Any additional scope beyond that agreed in the Engagement Letter will be discussed and agreed in writing before it proceeds. No additional charges will be applied without prior agreement.
Payment terms are set out in individual Engagement Letters. We do not offer refunds for work already completed and delivered. If an engagement is terminated before completion, fees will be charged for work done to the date of termination on a basis proportionate to the agreed scope.
7. Service Delivery and Scope
Each engagement is conducted in accordance with the scope set out in the Engagement Letter. We will notify you promptly if circumstances arise that may affect the scope or timeline of the engagement.
Timelines provided are estimates. Legal proceedings are subject to the scheduling and procedural requirements of the relevant authority and cannot be controlled by Anantara Law. We will keep you informed of any material changes to the expected timeline.
All communications, documents, and advice produced in the course of an engagement are treated as confidential to the client and governed by our professional obligations under the Legal Profession Act B.E. 2528 and related regulations.
8. Disclaimers
This website provides general information about Anantara Law and its Services. Nothing on this website constitutes legal advice, and no client relationship is formed by accessing or using this website alone.
Legal proceedings carry inherent uncertainty. We will provide our most considered professional assessment of your matter, but we make no representation that any particular outcome will be achieved. We will be candid with you about the realistic range of possibilities at each stage.
We endeavour to keep the information on this website accurate and current, but we make no warranty as to its completeness or accuracy.
9. Limitation of Liability
To the extent permitted by Thai law, Anantara Law's liability for any claim arising from the provision of Services is limited to the fees paid for the specific engagement to which the claim relates.
We are not liable for indirect, consequential, or punitive damages arising from the use of our website or Services, including loss of data, loss of profits, or adverse outcomes in legal proceedings where we have conducted ourselves in accordance with our professional obligations.
We are not responsible for the content or practices of any third-party websites linked from this website.
10. Indemnification
You agree to indemnify and hold Anantara Law harmless against any claims, damages, or costs (including legal fees) arising from your breach of these Terms & Conditions or from inaccurate or misleading information you have provided to us.
11. Termination
Either party may terminate an engagement by written notice. Termination does not affect accrued rights or obligations. Where a client terminates an engagement, fees for work completed to that date will remain payable. Where Anantara Law terminates an engagement for cause (including non-payment or material breach), fees for completed work will remain payable.
Provisions relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive termination.
12. Dispute Resolution and Governing Law
These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these Terms or our Services will first be subject to good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days of written notice, either party may refer it to the competent courts of Bangkok, Thailand, which will have exclusive jurisdiction.
13. General Provisions
- Entire Agreement: These Terms & Conditions, together with any applicable Engagement Letter, constitute the entire agreement between you and Anantara Law with respect to the subject matter.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our obligations in connection with a firm restructure, provided client interests are maintained.
- Notices: Formal notices under these Terms should be sent to [email protected] or to our registered office address.
14. Changes to These Terms
We may update these Terms & Conditions from time to time. Material changes will be indicated by an updated "Last Updated" date at the top of this page. Continued use of our website or Services following a change constitutes acceptance of the revised terms. We recommend reviewing this page periodically.
