Last Updated: 18 April 2025
This policy applies to Anantara Law, a legal practice registered in Thailand, operating from 78 Asok Montri Road, Khlong Toei, Bangkok 10110. Questions about this policy may be directed to [email protected].
1. Introduction and Scope
Anantara Law is committed to handling the personal information of clients, prospective clients, and website visitors with care and discretion. This policy explains what personal data we collect, why we collect it, how we use it, and what rights you have in relation to it.
Given the nature of our work — legal services relating to pension and retirement entitlement matters — we routinely receive sensitive financial and personal information. We treat all such information with the same standard of confidentiality we apply to legally privileged material.
This policy applies to data collected through our website at anantara.live, through our contact form, and through any other communication with Anantara Law in connection with a potential or active engagement.
2. Personal Data We Collect
We collect personal data in the following ways:
- Contact form submissions: name, email address, phone number (optional), and any information included in the message field.
- Engagement communications: additional personal information, financial records, and legal documents shared in the course of instructing us.
- Website analytics: anonymised usage data including pages visited, approximate location, device type, and referral source, collected through analytics cookies with your consent.
- Cookies: as described in our Cookie Policy.
We do not collect payment card details through our website. Fee arrangements are handled separately and directly.
Legal basis for processing: We process personal data on the basis of (a) your consent where given, (b) the performance of or preparation to enter a contract for legal services, and (c) our legitimate interest in responding to enquiries and improving our services.
Retention: Contact form enquiries not leading to an engagement are retained for 12 months. Matter-related records for active or concluded engagements are retained for 7 years in accordance with professional practice requirements under Thai law, after which they are securely deleted.
3. How We Use Your Personal Data
- To respond to your enquiry and assess whether and how we may assist you.
- To conduct and manage your legal matter if you instruct us.
- To communicate with relevant authorities, institutions, and third-party correspondents as required by your matter.
- To comply with our professional obligations under Thai law and the regulations of the Lawyers Council of Thailand.
- To improve our website and understand how visitors use it, using anonymised analytics data.
We do not use your personal data for unsolicited marketing. If we send any periodic communications about legal developments relevant to pension matters, we will do so only with your explicit consent and will include a clear means to unsubscribe.
4. Data Sharing
We share personal data only where necessary to conduct your matter or comply with legal obligations. This may include:
- Relevant authorities: the Social Security Office, private pension fund administrators, and other bodies involved in your matter.
- Legal correspondents: overseas legal firms coordinating on cross-border elements of a matter, under confidentiality obligations.
- Service providers: our website hosting provider and analytics provider, who process data only on our behalf and under data processing agreements.
- Professional regulators: where disclosure is required by the Lawyers Council of Thailand or applicable law.
We do not sell, rent, or trade personal data to any third party.
5. Data Protection Measures
- Our website uses HTTPS encryption for all data transmitted through the contact form.
- Client files and documents are stored on access-controlled systems with restricted internal permissions.
- Physical documents containing personal information are stored securely and disposed of by certified shredding.
- In the event of a data breach that may affect your rights, we will notify you without undue delay and take immediate steps to contain the breach.
6. Cookies
Our website uses cookies for essential functionality, analytics (with consent), and user preference storage. A full description of the cookies we use, their purpose, and how to manage them is available in our Cookie Policy.
7. Your Rights
Under Thailand's Personal Data Protection Act B.E. 2562 (PDPA), you have the following rights in relation to your personal data held by Anantara Law:
- Access: the right to request a copy of the personal data we hold about you.
- Rectification: the right to request correction of inaccurate data.
- Erasure: the right to request deletion of your data where we no longer have a legitimate basis to hold it.
- Portability: the right to receive your data in a structured, machine-readable format where technically feasible.
- Objection: the right to object to processing based on legitimate interest.
- Withdrawal of consent: where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
- Complaint: the right to lodge a complaint with the Office of the Personal Data Protection Committee of Thailand if you believe your rights have been infringed.
To exercise any of these rights, contact us at [email protected]. We will respond within 30 days.
8. Third-Party Links
Our website may contain links to external websites — relevant authorities, regulatory bodies, or resources we consider useful. We are not responsible for the privacy practices of those sites. We encourage you to review their privacy policies before providing any personal information.
9. Children's Privacy
Our services are directed at adults and are not intended for individuals under 18 years of age. We do not knowingly collect personal data from minors. If you believe we have inadvertently received such data, please contact us and we will promptly delete it.
10. International Data Transfers
Where your matter involves cross-border pension entitlements, we may need to share relevant documents with legal correspondents or institutions in other countries. We take care to ensure that any such transfer is made under appropriate safeguards, including contractual obligations on recipients to maintain equivalent standards of confidentiality and security.
11. Policy Updates
